Title
Amending Title 21 of The Philadelphia Code, entitled Miscellaneous, by adding provisions requiring members of Boards and Commissions of the City of Philadelphia to conduct certain of their deliberations, including deliberations with respect to adjudications pending before the Board or Commission, only at meetings open to the public, with certain exceptions, and under certain terms and conditions.

SECTION 1. Title 21 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 21-1500. BOARDS AND COMMISSIONS - PUBLIC DELIBERATIONS.
§21-1501. Definitions.
(1) Adjudication. Any final order, decree, decision, determination or ruling by a Board or Commission affecting personal or property rights, privileges, immunities, duties, liabilities or obligations of any or all of the parties to the proceeding in which the adjudication is made.
(2) Board or Commission. A Board or Commission created by or pursuant to the provisions of the Philadelphia Home Rule Charter.
(3) Deliberations. Discussions between or among members of a Board or Commission held for the purpose of making an Adjudication.
§21-1502. Public Deliberation Required.
(1) The members of a Board or Commission shall conduct Deliberations only at meetings of the Board or Commission that are open to the public and for which notice has been published in accordance with applicable law.
(2) Exception. Members of a Board or Commission may conduct Deliberations at an executive session of the Board or Commission closed to the public only to the least extent necessary to prevent the disclosure of confidential information protected by law, and only if such executive session is conducted in accordance with all requirements of the Sunshine Act, 65 P.S. §701 et seq.
