Title

Authorizing the Commissioner of Parks and Recreation, on behalf of the City of Philadelphia, to enter into a multiyear agreement with Cosmic Catering, LLC, for the management and operation of the Lloyd Hall Recreation Center Café, all under certain terms and conditions.

 

Body

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1. The Commissioner of Parks and Recreation, on behalf of the City of Philadelphia, is authorized to enter into a multiyear agreement with Cosmic Catering, LLC, for the management and operation of the Lloyd Hall Recreation Center Café, pursuant to terms substantially set forth in Exhibit “A” of this Ordinance.

 

SECTION 2. The City Solicitor is hereby authorized to review and approve the multiyear agreement authorized by this Ordinance, which multiyear agreement shall contain such terms and conditions as the City Solicitor shall deem necessary and proper to protect the interests of the City of Philadelphia and to carry out the purpose of this Ordinance.

 

 

EXHIBIT A

Terms of Proposed Multiyear Agreement

For Management and Operation of the Lloyd Hall Recreation Center Café

 

1.  Concessionaire:                       Cosmic Catering, LLC.

2.  Licensed Area:                      Lloyd Hall Recreation Center Café.

3.  Purpose:                     Café Management and Operation.

4.  Commencement Date:                       November 6, 2022.

5.  Term:                       The Initial Term of the Agreement shall be for five (5) years. The City may exercise the option to renew the Term with a Renewal Term of five (5) years.

6.  Concession Fee:                       Concessionaire to pay Concession Fee pursuant to the Agreement.

7.  Capital Improvements:                     Concessionaire will make improvements to the licensed area subject to the approval of the Department of Parks and Recreation and pursuant to the Capital Investment Plan submitted in the Concessionaire’s proposal, attached to the Agreement.

8.  Equal Economic Opportunity:                     In accordance with an executed Antidiscrimination Policy attached to the Agreement.
