THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to the owner of the property identified below, currently FLY PROPERTIES LLC, or the owner's designee (the "Owner"), to install, own, and maintain an encroachment at the Property, as follows:

Encroachment Description:

Property: 743 S. 4th Street Philadelphia, PA 19147 D/B/A Fitz on 4th

A sidewalk caf? located as follows, with a minimum of six feet (6'-0") of clear passable sidewalk space to remain after installation of each part identified below:

A total of four (4) tables and eight (8) seats for a sidewalk caf? and two (2) rectangular benches will be located along the east sidewalk of South 4th Street along the property line of 743 South 4th Street and along the south sidewalk of Fitzwater Street along the property line of 743 South 4th Street written in two parts:

Part 1

Four (4) tables and eight (8) seats will be located adjacent to the building of 743 South 4th Street and will encroach a distance of approximately six feet (6'-0") towards the north along the south footway of Fitzwater Street starting from a point approximately sixteen feet two inches (16'-2") east of the South 4th Street east curb line to a point approximately seventeen feet ten inches (17'-10") farther east leaving a minimum of six feet (6'-0") of clear unobstructed footway.

Part 2

Two (2) proposed rectangular benches will be located adjacent to the building of 743 South 4th Street and will encroach a distance of approximately two feet three inches (2'-3") towards the west along the east footway of South 4th Street starting from a point approximately thirteen feet two inches (13'-2') south of the Fitzwater Street south curbline to a point approximately eighteen feet eleven inches (18'-11") farther south leaving a minimum o...
