THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Chapter 14-1600 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 14-1600. MISCELLANEOUS.

§      14-1632.      Prohibition on licensed gaming facilities.

1. The erection, construction, alteration, or use of any licensed gaming facility as authorized by the Commonwealth of Pennsylvania, pursuant to 4 Pa. C.S., Part II, the “Pennsylvania Race Horse Development and Gaming Act,”  is prohibited within all zoning classifications.  

(2)      The Zoning Board of Adjustment shall not grant variances from the provisions of § 14-1632(1) except where the denial of a variance would effect an unconstitutional taking.

SECTION 2. Effective Date. This Oordinance shall take effect immediately.
