Amending Chapter 10-100 of The Philadelphia Code relating to animals by adding a new Section 10-104.2 entitled “Restraining of Dogs.”

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
 
 
SECTION 1.      Chapter 10 of The Philadelphia Code is hereby amended to read as follows:
 
CHAPTER 10-100. ANIMALS

§10-104.2      Restraining of Dogs.
 
(1)      Every dog shall be securely muzzled when off the premises of its owner or authorized agent of the owner.
 
(2)      Every vicious dog shall be confined by its owner or authorized agent of its owner to the residence of the owner or authorized agent.  Such residence shall be conspicuously posted with a placard provided by the Department of Public Health, or its designee, and shall state: “Warning! Dog on Premises.”  Whenever such a dog is off the premises of its owner, the owner or authorized agent shall comply with §10-104.2(1) and shall be restrained with a chain having a minimal tensile strength of three hundred (300) pounds and not more than three (3) feet in length or caged.
 
(3)      The penalty for violation of this Section shall be a fine of $300.00 per violation.
 
SECTION 2.      Severability.  It is Council's intent that the provisions of Chapter 10-100 of The Philadelphia Code as added by Section 1 of this Ordinance, as severable, and if any provision thereof shall be held illegal, invalid, unconstitutional or inapplicable to any circumstances, such illegality, invalidity, unconstitutionality or inapplicability shall not affect or impair any of the remaining provisions of that Chapter or their application to such circumstances.
 
SECTION 3.        This Ordinance shall take effect immediately.
