Title
Amending Section 20-101 of The Philadelphia Code, entitled Residence Requirements, by providing that active law enforcement officers from elsewhere in the United States entering into civil service positions in the Philadelphia Police Department need not be bona fide residents of the City when appointed, but must establish and maintain bona fide residence in the City within six months after appointment.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Section 20-101 of The Philadelphia Code is hereby amended to read as follows:
§20-101. Residence Requirements.
(1) No person shall be appointed as an employee in the civil service of the City unless he or she has been a bona fide resident of the City for at least one year prior to his or her appointment, except that police and law enforcement officers currently employed in the United States and certified by their state or municipality who apply for civil service positions in the Philadelphia Police Department and who are appointed before October 31, 2005 shall have six months after appointment to establish bona fide residence in the City and shall thereafter maintain bona fide residence in the City.
(2) Every employee in the civil service shall maintain his or her bona fide residence in the City, except to the extent set forth in subsection 20-101 (1) with respect to active law enforcement officers from elsewhere in the United States. The City Controller may require proof of the residence of any employee in the civil service.
(3) The Civil Service Commission may, upon the request of the Personnel Director, waiver the above residence qualifications when in its discretion the circumstances warrant a waiver.
