THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Subcode PM of Title 4 of The Philadelphia Code, as it takes effect July 1, 2015 pursuant to Bill No. 120647 (approved January 20, 2014), and Bill No. 140856 (approved December 19, 2014), is hereby amended to read as follows:

SECTION PM-308
RUBBISH AND GARBAGE

PM-308.1 Accumulation of rubbish or garbage. All exterior property and premises, and the interior of every structure, shall be free from any accumulation of rubbish or garbage.

PM-308.2 Disposal of rubbish. Every occupant of a structure shall dispose of all rubbish in a clean and sanitary manner by placing such rubbish in approved containers[.], and shall also dispose of all recyclable materials (material listed in ยง 10-717(2)(a)) by placing such materials in an approved container required by Section PM-308.2.1.

PM-308.2.1 Rubbish storage facilities. The owner of every occupied premises shall supply approved covered containers for rubbish, and a separate, approved container for recyclable materials. [and the] The owner of any premises containing ten or more dwelling units shall provide one rubbish and one recycling container in the area of the building designated as the lobby or foyer or other designated areas inside the premises, without obstructing ingress or egress; or in a secure outside area adjacent to the premises, not in a public right-of-way, and at a minimum distance of five (5) feet from any entrance to the premises.
