Authorizing the Committee on Licenses and Inspections to hold a hearing to examine the implementation and enforcement of laws and regulations governing nuisance businesses, including Stop and Go establishments, signage, and window coverings, and to assess how enforcement practices can improve public safety, strengthen community trust, ensure due process, and reduce neighborhood conflict
Body
WHEREAS, Certain businesses and commercial establishments may, depending on their operations and surrounding circumstances, generate recurring quality-of-life, public safety, health, or nuisance concerns in Philadelphia neighborhoods; and
WHEREAS, Community members have raised concerns regarding the concentration and operation of certain nuisance businesses in particular neighborhoods and have requested greater transparency regarding how complaints are received, investigated, and addressed; and
WHEREAS, The Department of Licenses and Inspections (“L&I”), the Philadelphia Department of Public Health, and other City departments and agencies have various authorities to inspect establishments, enforce applicable laws and regulations, and, where authorized by law, suspend or revoke licenses or take other enforcement action; and
WHEREAS, City Council seeks to better understand how those enforcement authorities are currently implemented, including the circumstances under which establishments may be cited, fined, closed, or otherwise subject to enforcement action; and
WHEREAS, Community members and business owners have requested greater clarity regarding the City's enforcement processes, including how complaints are investigated, how enforcement decisions are made, and what factors may result in immediate or expedited action; and
