THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. The City of Philadelphia (the "City") is hereby authorized to lease for public purposes from Tinicum Township, Delaware County, an approximately 21.8 acre parcel of land (the "Premises") owned by and within Tinicum Township and adjacent to Philadelphia International Airport (the "Airport"), which is currently intended for use as a safety zone at the end of an Airport runway, the Premises being more fully set forth on Exhibit "A" attached hereto and made a part hereof with the metes and bounds set forth on such exhibit approximations and not necessarily exact.

SECTION 2. The Commissioner of Public Property and the Director of Commerce, or their designee(s), acting on behalf of the City, are hereby authorized to (a) execute and deliver a lease agreement ("Lease") with Tinicum Township for the lease of the Premises for a ten (10) year term with the option to renew the Lease for one additional term of ten (10) years and (b) take any and all further actions as may be necessary or appropriate to accomplish the intent and purpose of this Ordinance.

SECTION 3. The Lease shall be substantially in the form set forth in Exhibit "B" attached hereto and made a part hereof, with such changes as the City Solicitor deems necessary or appropriate to protect the interests of the City.
