Amending Title 19 of The Philadelphia Code, entitled "Finance, Taxes and Collections," to require City depositories to install systems that permit immediate audio connection to 911 emergency service in certain automated teller machines.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Title 19 of The Philadelphia Code is amended as follows:

(8) ATM 911 Connection Requirement.
(a) For purposes of this subsection:
(.1) an "unattended ATM" is an automated teller machine that is located on the outside of a building or structure, or within a building or structure that is accessible at times when the business to which the machine is appurtenant, whether a bank or other business, is not open;
(.2) an "access device" is a card, code or other means of access to a consumer's account, or any combination thereof, that may be used by the consumer for the purpose of initiating transactions through an automated teller machine.
(b) On July 1, 2006, and thereafter, every unattended ATM operated by a City depository must be equipped with a functioning system permitting immediate two-way audio connection to 911 emergency service, by pressing a button or through a similar device, that is activated upon utilization of an access device.
(c) City depositories shall display in a conspicuous place in the area of every such automated teller machine a notice as to the availability of the 911 connection system and a warning that connecting the system to 911 under false pretenses is an offense subject to prosecution.
