Amending Title 9 of The Philadelphia Code, entitled “Regulation of Businesses, Trades and Professions,” by prohibiting the sale of foie gras in the City of Philadelphia and providing penalties for violations, under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
 
SECTION 1.  Title 9 of The Philadelphia Code is hereby amended to read as follows:
 
TITLE 9. REGULATION OF BUSINESSES, TRADES AND PROFESSIONS.

§9-629. Sale of Foie Gras Prohibited.
 
(1)      No person shall sell foie gras within the City of Philadelphia.
 
(2)      For purposes of this section:
 
      (a)      “Foie gras” means any food containing the liver of a bird, which has been enlarged beyond normal size through forced feeding.
 
      (b)      A “bird” means any member of the avian family, including but not limited to a duck or goose.
 
      (c)      “Forced feeding” means causing a bird to ingest an excessive quantity of food, or more food than a typical bird of the same species would consume voluntarily while foraging. Force feeding methods include, but are not limited to, delivering feed through a tube or other device inserted into the bird's esophagus.
 
(3)      Violations of this section are “Class II” offenses subject to the penalties provided in §1-109.

      SECTION 2. This Ordinance shall take effect ninety (90) days after it becomes law.
