Title

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
 
SECTION 1.  Section 2 of Bill No. 040595 (approved June 15, 2005) is hereby repealed.
 
SECTION 2.  Section 9-605 of The Philadelphia Code is hereby amended to read as follows:
 
TITLE 9. REGULATION OF BUSINESSES, TRADES AND PROFESSIONS.

§9-605.      Towing.

(4)      Rotation method of tow truck selection.  
 
            (a)      Upon the City's establishment [by competitive process] of a rotational towing system, no person shall engage in towing from the scene of an accident or with respect to a disabled vehicle that is either impeding traffic or on the shoulder of a limited access highway unless that person has either been selected through operation of such rotational system or has been selected or permitted to perform such tow from a state highway by the State Police.

(d)      The City may charge a fee in connection with the towing of vehicles pursuant to a rotational system. City and tower fees [established] in connection with a rotational system or non-consensual tows directed by the State Police shall be [set] established or limited by regulation.
