Title
Amending Title 9 of The Philadelphia Code, entitled "Regulation of Businesses, Trades and Professions," by adding a section requiring a permit for the placement of drop-off bins for the receipt of donations of clothing and household items and establishing maintenance requirements in connection with such bins, under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
Section 1. Title 9 of The Philadelphia Code is amended as follows:

ยง9-215. Donation Drop-Off Bins.
(1) Definitions.
(a) Donation drop-off bin. A container or bin used for the purpose of receiving donations of clothing or household items for retrieval by the container or bin owner or user.
(2) Prohibited and required conduct.
(a) No person shall place or maintain a donation drop-off bin in a location accessible to the general public, or permit such placement of a donation drop-off bin on his or her property, unless a permit issued by the Department of Licenses and Inspections has been obtained in connection with placement of the bin and such permit is affixed to the bin.
(b) Any person who has placed a donation drop-off bin in a location accessible to the general public, or permitted placement of a donation drop-off bin on his or her property, shall:
(i) ensure that the bin is emptied at least once per week; and
(ii) keep the area around the bin clean and free from overflowing donations of clothing or other household items.
(3) Donation drop-off bin permit.
(a) An application for a donation drop-off bin permit shall be made to the Department of Licenses and Inspections and shall include:
(1) the name, address and telephone number of the person applying for the permit;
