Authorizing Tony Elebah to construct, own and maintain, an open-air sidewalk cafe at 2457-2459 North 54th Street, under certain terms and conditions.
Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Tony Elebah, to construct, own and maintain an open-air sidewalk café at 2457-2459 North 54th Street, that will encroach upon the east sidewalk of North 54th Street as follows:

The three (3) tables and six (6) chairs, approximately two feet (2') by two feet (2') are to accommodate six (6) occupants. The tables encroach approximately three feet (3') onto the east sidewalk of N. 54th Street, leaving approximately thirteen feet six inches (13'- 6") of clear unobstructed footway.

The three (3) tables and six (6) chairs are to be placed adjacent to the curb line with a four foot (4') offset. The first table is located approximately three hundred feet (300') north of the north curb line of Overbook Avenue and the last table approximately three hundred fifty feet (350') north of the north curb line of Overbrook Avenue.

SECTION 2. The construction, use and maintenance of the open-air sidewalk café described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections and the Department of Streets, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering practice.

SECTION 3. Before exercising any rights or privileges under this Ordinance, Tony Elebah, must first obtain or have their contractor(s) obtain all required permits, licenses and approvals from all appropriate departments, boards, agencies or commissions.
