Title
Amending Sections 3-306 and 3-401 of Title 3 (“Air Management Code”) of The Philadelphia Code, to eliminate dual licensing and permitting requirements on air contaminant emitting facilities, and to clarify air pollution control standards, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
 
Section 1. Title 3 of The Philadelphia Code is hereby amended to read as follows:
 
                  TITLE 3.  AIR MANAGEMENT CODE.

            CHAPTER 3-400.  AIR POLLUTION CONTROL PROGRAM.
 
§ 3-401.  Delegation to Air Pollution Control Board and the Department of Public Health.
 
      (1)  The Air Pollution Control Board is hereby authorized to adopt by regulation an air pollution control program that is [no less stringent, and no more stringent, than] at least as stringent as the requirements of the Commonwealth of Pennsylvania Air Pollution Control Act (Act of January 8, 1960 (1959 P.L. 2119, No. 787) as amended) (the “Act”) and the Federal Clear Air Act, 42 U.S.C. Section 7401 et seq., and rules and regulations promulgated pursuant to to those acts.  Such program shall include, but not be limited to, the following:
