Title

Authorizing the Commissioner of Public Property on behalf of the City to execute and deliver to the Philadelphia Authority for Industrial Development a deed conveying fee simple title to all or part of a certain approximately 4 acre parcel of land with the buildings and improvements thereon located in the vicinity of the intersection of Belmont Avenue and Monument Road, for further conveyance to the Commonwealth of Pennsylvania for nominal consideration, under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

                     SECTION 1.                     The Commissioner of Public Property on behalf of the City of Philadelphia is hereby authorized to execute and deliver to the Philadelphia Authority for Industrial Development, for nominal consideration, a deed conveying fee simple title to all or part of a certain parcel of land with the buildings and improvements thereon, generally described as follows, for further conveyance to the Commonwealth of Pennsylvania for nominal consideration, for use by the State Police:

 

ALL THAT CERTAIN lot or piece of ground with the buildings and improvements thereon erected.

 

Situate in the 52nd Ward of the City of Philadelphia, and described according to a Survey and Plan of Property made by John Reilly Surveyor & Regulator of the Seventh Survey District dated May 15, 1968:

 

BEGINNING AT A POINT on the Easterly side of Belmont Avenue 100 feet wide, legally open, on City Plan, at the distance 421.780 feet northwestwardly from the intersection of the easterly side of said Belmont Avenue and the northwestwardly side of Monument Road 60 feet wide, legally open, on City Plan:

Thence extending N.10°05’46”W. along the said easterly side of Belmont Avenue the distance of 407.360 feet to a point;

Thence extending N.79°54’14”E. the distance of 255.000 feet to a point;

Thence extending S.55°29’09”E. the distance of 289.270 feet to a point;

Thence extending S.73°15’46”E. the distance of 85.828 feet to a point on the said northwestwardly side of Monument Road;

Thence extending S.16°44’14”W. along the said northwestwardly side of Monument Road the distance of 136.068 feet to a point of curve;

Thence extending still along the same on a line curving to the right having a radius of 789.770 feet the arc distance of 50.208 feet to a point;

Thence extending S.79°54’14”W. the distance of 452.025 feet to a point; said point being the first mentioned point and place of beginning.

 

CONTAINING IN TOTAL AREA  174,048 SQ. FT. or 3.9956 acres.

 

                     SECTION 2.                     The Commissioner of Public Property on behalf of the City of Philadelphia is hereby authorized to create or reserve from such conveyance an easement or easements for water and sewer purposes to be more particularly described in accordance with a survey.

 

                     SECTION 3.  The Commissioner of Public Property on behalf of the City of Philadelphia is hereby authorized to create or reserve from such conveyance such other easements, and to impose such restrictions, as may be necessary or desirable.  Such restrictions may include a restriction that the premises be used solely by the State Police for any use they deem appropriate in furtherance of their law enforcement mission.

 

                     SECTION 4.                     The City Solicitor is hereby authorized to review and approve all instruments and documents necessary to effectuate this Ordinance, which instruments and documents shall contain such terms and conditions as the City Solicitor shall deem necessary and proper to protect the interests of the City and to carry out the purposes of this Ordinance.
