THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
 
SECTION 1. Chapter 6-300 of The Philadelphia Code is hereby amended to read as follows:
 
CHAPTER 6-300.  FOOD.
 
§ 6-301. Food Establishments.

      (3)      Every person applying for such license shall supply such information and shall permit such inspection and examination of his food establishment and the food and persons handling food therein as the Board may by regulation prescribe to protect the health of ultimate consumers.
 
            (a)      A license to operate as a mobile food vendor must be renewed on a semiannual basis, and no such license shall be approved or renewed unless the Department has inspected the vending cart or vehicle and determined that it is in compliance with all applicable health and safety requirements of this Code and the regulations adopted by the Board thereunder and that the vendor has identified to the Department the individual(s) holding a valid Food Establishment Personnel Food Safety Certificate who will be present during operation, as required by subsection (8) of this Section.
 
            (b)      No mobile food vendor license shall be approved or renewed unless the Department has determined that the mobile food vendor has obtained an off-street parking location in which to park and store the vehicle whenever food is not being loaded or off-loaded, prepared, manufactured, cooked, processed, dressed, served or distributed from that vehicle and that the mobile food vendor is in compliance with Section 12-901(4) of The Philadelphia Code.

SECTION 2. Chapter12-900 of The Philadelphia Code is hereby amended to read as follows:
 
CHAPTER 12-900.  PARKING REGULATIONS AND PENALTIES.
 
§ 12-901. Stopping, Standing or Parking Prohibited at Certain Places.

      (4)      No mobile food vendor shall stop, stand or park a mobile vending vehicle on any public street or right-of-way whenever food is not being loaded or off-loaded, prepared, manufactured, cooked, processed, dressed, served or distributed from that vehicle.

SECTION 3. This Ordinance shall become effective upon becoming law.
