Authorizing Mick Hally to construct, own and maintain, an open-air sidewalk cafe at 1148-1150 S. 11th Street, under certain terms and conditions.
Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Mick Hally, to construct, own and maintain an open-air sidewalk café at 1148-1150 S. 11th Street that will encroach upon the west sidewalk of S. 11th Street and the south sidewalk of Ellsworth Street as follows:

There will be four (4) tables and sixteen (16) chairs in total.

Three (3) tables and twelve (12) chairs will be placed adjacent to the building on the west sidewalk of S. 11th Street. The tables encroach approximately four feet (4'), leaving approximately seven feet six inches (7'-6") of clear unobstructed footway. No rails will be used.

One (1) table and four (4) chairs will be placed adjacent to the building on the south sidewalk of Ellsworth Street. The table will encroach approximately four feet (4'), leaving approximately five feet (5') of clear unobstructed footway. No rails will be used.

SECTION 2. The construction, use and maintenance of the open-air sidewalk cafe described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections and the Department of Streets, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering practice.

SECTION 3. Before exercising any rights or privileges under this Ordinance, Mick Hally must first obtain or have his contractor(s) obtain all required permits, licenses and approvals from all appropriate departments, boards, agencies or commissions.
