Title
Amending Title 16-400 of The Philadelphia Code directing the Commissioner of Public Property to transfer certain property; requiring the transfer of certain property for nominal consideration; and requiring Vacant Property Review Committee approval for Urban Garden Agreements, all under certain terms and conditions.

Amend 16-405
 
      (1)  Upon adoption of a Resolution, as prescribed in Chapter 16-502, the Commissioner of Public Property is hereby authorized and directed to transfer title to any property or ground to which he/she has accepted title under the provisions and conditions of this Chapter or any surplus property or ground made available for distribution in accordance with the terms of this Chapter to the Redevelopment Authority of the City of Philadelphia, with or without consideration.  The Commissioner of Public Property shall execute and deliver to the Redevelopment Authority deeds conveying fee simple title to City-owned property for the purpose of rehabilitation [and] or other use in accordance with the Comprehensive Land Use Plan of the City of Philadelphia providing the Redevelopment Authority shall reimburse the City, upon sale of the property so conveyed, to the extent of the net proceeds thereof and that the property or ground so transferred shall be held by the Redevelopment Authority for a period not to exceed three (3) years after which it shall be transferred back to the City if the Vacant Property Review Committee determines that the property or ground can be used to further accomplish the provisions of this Chapter.
 
§16-407.  Disposition to Subsidized Projects.
 
      (1)  Disposition of property or ground, under this Chapter, to projects that require and receive federal, state or local governmental subsidized financial assistance shall be for nominal value.
 
§16-408.  Urban Gardens.
 
      (1)  Any agreement, license or other document that authorizes any citizen, group of citizens, civic association or any other legal entity, to enter upon and use any City owned property for gardening or related uses, shall require the review and recommendation of the Vacant Property Review Committee and approval of City Council by Resolution.
