Authorizing 217 West George Street LLC to construct, own and maintain an open-air sidewalk café at 217 West George Street, under certain terms and conditions.

Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to 217 West George Street LLC ("Owner") to construct, own and maintain various sidewalk encroachments at 217 West George Street as follows ("Encroachments"):

One (1) table and two (2) chairs shall be located adjacent to the building and encroach approximately two feet (2') onto the north sidewalk of West George Street, leaving approximately five feet (5') of clear, unobstructed footway. No rails will be used.

Eight (8) tables and sixteen (16) chairs shall be located adjacent to the building and encroach approximately five feet (5') onto the east sidewalk of North American Street, leaving approximately five feet (5') unobstructed footway. No rails will be used.

The exact number, type and location of the Encroachments are identified on plans that have been supplied to the Department of Streets for review and have been approved. The Department of Streets will maintain the authority to review and approve the location of each proposed encroachment prior to installation.

SECTION 2. Before exercising any rights or privileges under this Ordinance, Owner must first obtain all required permits, licenses and approvals from all appropriate City departments, boards, agencies or commissions. No such department, board, agency or commission shall be required to issue any such permit, license or approval solely because this Ordinance has been enacted, it being the express intent of this Ordinance not to supersede any other provision of law governing the issuance of such permits, licenses or approvals. In addition, before exercising any rights or privileges under this Ordinance, Owner shall enter into an agreement ("Agreement") with the appropriate City department(s), in a form satisfactory to...
