Authorizing the striking from City Plan No. 42 and abandoning of a portion of a certain right-of-way reserved for municipal and public utility purposes which extends southwestwardly from the westerly side of former Thirty-second Street, south of Market Street, under certain terms and conditions.

Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Pursuant to Section 11-403 of The Philadelphia Code, the Board of Surveyors of the Department of Streets is hereby authorized to strike from City Plan No. 42 and abandon the northwesterly twenty-three feet wide portion of a certain sixty feet wide right-of-way reserved for municipal and public utility purposes which extends from the westerly side of former Thirty-second Street (stricken from City Plan and reserved as a right-of-way for drainage purposes, water main purposes, gas main purposes, and public utility purposes), approximately eight feet south of Market Street, southwestwardly approximately four-hundred sixty-six feet, connecting at its southwesterly end with a right-of-way for gas main purposes and public utility purposes which extends southwardly to the northerly side of Chestnut Street.

SECTION 2. This authorization is conditional upon compliance with the following requirements within two (2) years from the date this Ordinance becomes law:
(a) The filing of an agreement, satisfactory to the City Solicitor, by the party in interest, to release, indemnify, and defend the City from all damages or claims for damages that may arise by reason of the City Plan changes authorized herein.
(b) The filing of an agreement, satisfactory to the City Solicitor, by the party in interest, to make any and all changes and adjustments to any public utility facilities maintained within the right-of-way being affected which may be necessary in the judgment of the owners of said facilities. The agreement shall provide that this work be completed within one year from the date of approval...
