Authorizing Kimmel Center, Inc., 200 South Broad Street, Philadelphia, Pennsylvania, owner of the Kimmel Center located at 300 South Broad Street, to construct, own and maintain various encroachments in the right-of-way on the south sidewalk of Spruce Street between Broad and Fifteenth Streets, under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Kimmel Center, Inc. to construct, own and maintain various right-of-way encroachments as follows:

The proposed building encroachment will be located on the south sidewalk of Spruce Street and will encroach onto the sidewalk approximately four feet (4') leaving approximately twelve feet (12') of clear unobstructed footway for pedestrian traffic. The proposed encroachment will begin approximately one hundred-one feet (101') west of the west curbline of South Broad Street and will end approximately two hundred ninety-one feet (291') west of the west curbline of South Broad Street. The total frontage for the proposed encroachment will be approximately one hundred-ninety feet (190').


SECTION 2. Before exercising any rights or privileges under this Ordinance, Kimmel Center, Inc. must first obtain or have its contractor(s) obtain all required permits, licenses and approvals from all appropriate departments, boards, agencies or commissions. No such department, board, agency or commission shall be required to issue any such permit, license or approval solely because this Ordinance has been enacted, it being the express intent of this Ordinance not to supersede any other provision of law governing the issuance of such permits, licenses or approvals. In addition, before exercising any rights or privileges under this Ordinance, Kimmel Center, Inc. shall enter into an agreement ("Agreement") with the appropriate City department or departments, satisfactory to the City Solicitor, to provide that Kimmel Center, Inc., shall...
