Authorizing Milk & Honey LLC to construct, own and maintain an open-air sidewalk café at 4435 Baltimore Avenue, under certain terms and conditions.

Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Milk & Honey LLC, owner of Milk & Honey Market ("Owner"), to construct, own and maintain various sidewalk encroachments at 4435 Baltimore Avenue as follows ("Encroachment"):

There will be four (4) tables to accommodate a total of twelve (12) occupants. Each table is approximately thirty (30) square inches in area. One (1) table and three (3) chairs will be located adjacent to the building and encroach approximately five feet (5') onto the east sidewalk of S. 45th Street, leaving approximately five feet (5') of clear unobstructed footway. Three (3) tables and nine (9) chairs will be located adjacent to the building and encroach approximately five feet (5') onto the north sidewalk of Baltimore Avenue, leaving nine feet-six inches (9'-6") of clear unobstructed footway. Neither encroachment will use rails.

SECTION 2. The construction, use and maintenance of the Encroachment described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections and the Department of Streets, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering practice.

SECTION 3. Before exercising any rights or privileges under this Ordinance, Owner must first obtain all required permits, licenses and approvals from all appropriate City departments, boards, agencies or commissions.
