THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Permission is hereby granted to University of Pennsylvania, Division of Facilities, 3101 Walnut Street, Philadelphia, PA 19104 ("Owner") to construct, own and maintain various right-of-way encroachments ("Encroachments") on Health Sciences Drive, Philadelphia, PA, more particularly described as follows:
The southeast corner of the building (Center for Advanced Medicine) will encroach into the right-of-way along Health Sciences Drive beginning approximately four hundred - thirty (430) feet east of the easterly curbline of East Services Drive for a length of approximately twenty-four (24) feet. The building encroaches from zero (0) feet to a maximum of six (6) feet into the right-of-way along Health Sciences Drive and the lower edge of the building will have a minimum clearance of forty-five (45) feet above the sidewalk.
SECTION 2. The construction, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections and the Department of Streets, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering practice.
SECTION 3. Before exercising any rights or privileges under this Ordinance, Owner must first obtain or have its contractor(s) obtain all required permits, licenses and approvals from all appropriate departments, boards, agencies or commissions.
