Authorizing East Falls Development Corporation to construct, own and maintain various right-of-way encroachments at 4168 Ridge Avenue, Philadelphia, PA, on Ridge Avenue and Midvale Avenue, under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Permission is hereby granted to East Falls Development Corporation, 3728A Midvale Avenue, Philadelphia, PA 19129 ("Owner") to construct, own and maintain various right-of-way encroachments ("Encroachments") on Ridge Avenue between Midvale Avenue and Indian Queen Lane and on Midvale Avenue between Ridge Avenue and E. River Road, Philadelphia, PA as follows:
Planters
Three (3) planters will encroach within the City right-of-way along the property line onto the south footway of Ridge Avenue between Midvale Avenue and Indian Queen Lane. The planters will extend approximately ten (10) feet as measured along the length of the footway and will encroach approximately three (3) feet leaving approximately ten (10) feet of clear unobstructed footway.
And
Three (3) planters will encroach within the city right-of-way along the property line onto the east footway of Midvale Avenue between Ridge Avenue and E. River Road. The planters will extend ten (10) feet as measured along the length of the footway and will encroach approximately three (3) feet leaving approximately seventeen (17) feet of clear unobstructed footway.
SECTION 2. The construction, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections and the Department of Streets, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering practice.
