Authorizing 39th and Sansom Streets Corporation t/a Cavanaugh's Leprechaun to construct, own and maintain an open-air sidewalk café at 119 S. 39th Street, Philadelphia, PA, under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to 39th and Sansom Streets Corporation t/a Cavanaugh's Leprechaun ("Owner") to construct, own and maintain various sidewalk encroachments at 119 S. 39th Street, Philadelphia, PA ("Encroachments") as follows:

A total of six (6) tables to accommodate a total of eighteen (18) occupants, are proposed as follows:

Three (3) tables and six (6) chairs will be located adjacent to the building and encroach approximately three feet (3') onto the south footway of Sansom Street leaving approximately six feet (6') of clear unobstructed footway.

And

Three (3) tables and twelve (12) chairs will be located adjacent to the building and will encroach approximately six feet (6') onto the east footway of S. 39th Street leaving approximately six feet - six inches (6' - 6") of clear unobstructed footway. No rails will be used.

SECTION 2. The construction, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections and the Department of Streets, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering practice.

SECTION 3. Before exercising any rights or privileges under this Ordinance, Owner must first obtain all required permits, licenses and approvals from all appropriate City departments, boards, agencies or commissions.
