Amending Chapter 18-200 of The Philadelphia Code, entitled "Airports," by providing that leases for certain concessions at Philadelphia International Airport shall include a provision requiring the lessee to exempt subtenants, that provide compensation to employees in accordance with the Philadelphia 21st Century Minimum Wage and Benefits Standard, from the requirement to use street pricing and by making technical changes, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Chapter 18-200 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 18-200. AIRPORTS

ยง 18-201. Leases of Airport Facilities.

(7) Concession Leases.

(a) Requirements. Any lease for a concession, including amendments and renewals, entered into between the City and any person for the procurement of food, beverage or retail vendors at Philadelphia International Airport shall provide that:

(.1) The lessee shall exempt subtenants, that provide compensation to employees in accordance with Section 17-1305, Philadelphia 21st Century Minimum Wage and Benefits Standard, from any requirement to set prices for products or services no higher than street prices (the price charged for the product or service at comparable locations in the Philadelphia area, by businesses operating under the same trade name or by comparable businesses).

(b) Responsibilities of Lessee. The lessee shall be responsible for monitoring subtenants for compliance with subsection (7)(a) and shall submit an annual report on compliance to the City Finance Director, the President of Council, and the Chief Clerk of Council.

(c) Enforcement. Failure of the lessee to comply with its responsibilities under subsection (7)(b) shall subject the lessee to enforcement in accordance with the provisions of Section 17-1312....
