Authorizing Beacon on E. Girard Inc. dba Kraftwork to construct, own and maintain an open-air sidewalk café at 541 E. Girard Avenue, Philadelphia, PA, under certain terms and conditions.

Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Beacon on E. Girard Inc. dba Kraftwork ("Owner") to construct, own and maintain various sidewalk encroachments at 541 E. Girard Avenue, Philadelphia, PA ("Encroachments") as follows:

A total of eighteen (18) tables to accommodate a total of thirty-six (36) occupants, are proposed as follows:

Four (4) tables and eight (8) chairs will be located adjacent to the building and five (5) tables and ten (10) chairs will be located along the curbline on the west footway of Montgomery Avenue and will encroach approximately seven feet (7') leaving approximately five feet (5') of clear unobstructed footway.

And

Six (6) tables and twelve (12) chairs will be located adjacent to the building and three (3) tables and six (6) chairs will be located along the curbline on the north footway of E. Girard Avenue and will encroach approximately seven feet - six inches (7' - 6") leaving approximately eight feet - six inches (8' - 6") of clear unobstructed footway. No rails will be used.

(Note: In accordance with Section 9-208(6)(1), the café tables may only be placed adjacent to the curb after 7:00 p.m.)

SECTION 2. The construction, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections and the Department of Streets, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering practice.
