Amending Chapter 10-100 of The Philadelphia Code, entitled "Animals," by providing requirements, relating to the retail sale of certain animals, under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Chapter 10-100 of The Philadelphia Code is hereby amended to read as follows:
CHAPTER 10-100. ANIMALS.

§ 10-101. Definitions.
In this Chapter the following definitions apply:

Offer for sale. To display, sell, deliver, offer for sale or adoption, advertise for the sale of, barter, auction, give away or otherwise exchange an animal.

§ 10-115. Retail Sale of Dogs and Cats.
* * *
(1) Restrictions on the retail sale of dogs and cats. An animal retailer shall offer for sale only those dogs and cats that the animal retailer has obtained from:
(a) An animal control center, animal care facility, kennel, pound or training facility, operated by any subdivision of local, state or federal government; or
(b) An animal shelter.
(2) Exemptions. The restrictions on animal retailers, set forth in subsection (1) of this Section , shall not apply to any entity listed in paragraphs (a) or (b) of subsection (1) or to any veterinary hospital or clinic licensed in the Commonwealth of Pennsylvania.
(3) Disclosure Requirement.
(a) Any animal retailer that offers for sale a dog or cat shall provide, to the purchaser of the dog or cat, a written disclosure that meets all the requirements of Section 201-9.3 of the Unfair Trade Practices and Consumer Protection Law, Act of December 17, 1968, P.L. 1224, No. 387, § 9.3, added, June 25, 1997, P.L. 287, No. 27, § 1, 73 P.S. § 201-9.3 (relating to protection of dog purchasers).
