THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Philadelphia Parking Authority ("Owner") to construct, own and maintain various right-of-way encroachments ("Encroachments") within the public right-of-way on Arch Street, Filbert Street, and Eighth Street, Philadelphia, PA as follows:

Arch Street Encroachment

Architectural embellishments will encroach no more than six feet (6') over the public right-of-way on the south footway of Arch Street between the east and west building lines of Eighth Street, and with a minimum clearance of eighteen feet (18') above the sidewalk.

Filbert Street Encroachment

Architectural embellishments will encroach no more than eight feet (8') over the public right-of-way on the north footway of Filbert Street, between the east and west building lines of Eighth Street, and with a minimum clearance of eighteen feet (18') above the sidewalk.

Eighth Street Encroachments

Architectural cladding will encroach no more than four inches (4") over the public right-of-way on the east and west footways of Eighth Street between the north building line of Filbert Street and the south building line of Arch Street.

SECTION 2. The construction, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections and the Department of Streets, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering practice.
