THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Permission is hereby granted to Old Nelson PA Four, LLC dba Old Nelson Food Company ("Owner") to construct, own and maintain various sidewalk encroachments at 3020 Market Street, Philadelphia, PA ("Encroachments") as follows:
Two (2) tables and four (4) chairs will be located adjacent to the building at 3020 Market Street and will encroach approximately two feet - zero inches (2'-0'') onto the south footway of Market Street leaving a minimum ten feet - seven and three quarter inches (10'-7 3/4 ") of clear unobstructed footway . No rails will be used.
Five (5) tables and ten (10) chairs will be located adjacent to the building at 3020 Market Street approximately eighteen feet - one and one half inches (18'-1 1/2 '') from the south curb line of Market Street and will encroach approximately four feet - zero inches (4' - 0") onto the south footway of Market Street leaving a minimum ten feet - three inches (10' - 3") of clear unobstructed footway. No rails will be used.
All Tables and Chairs are located within the east and west projections of the property line at 3020 Market Street approximately two hundred (200) feet east of the west curb line of 31st Street.
SECTION 2. The construction, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections and the Department of Streets, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering practice.
