Authorizing Joshua Shemesh ("Owner") to install, own and maintain an open-air sidewalk café at 1301 Frankford Avenue, Philadelphia, PA 19125 ("Property"), under certain terms and conditions.

Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Owner to install, own and maintain certain sidewalk encroachments at the Property ("Encroachments") as follows:

From a point where existing stairs meet the building, along the houseline of East Thompson Street, approximately sixty three (63) feet from the curbline of Frankford Avenue. From said point, extending forty four feet six inches (44'-6") towards Frankford Avenue, along the houseline of 1301 Frankford Avenue, and encroaching no more than five feet (5'-0") into the north footway of East Thompson Street, a maximum of ten (10) tables and twenty (20) chairs will be placed, with seven feet (7'-0") of clear footway remaining, with intermittent obstructions leaving five feet two inches (5'-2") or more feet of available walking space. No rails will be used.

SECTION 2. The installation, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses & Inspections and the Department of Streets, provided that the Department of Streets, in its sole discretion, may allow minor variations of the dimension limits set forth in Section 1, within standard tolerances of current engineering practice.

SECTION 3. Before exercising any rights or privileges under this Ordinance, Owner must first obtain all required permits, licenses and approvals from all appropriate City departments, boards, agencies or commissions.
