THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Permission is hereby granted to Ruben Burgos ("Owner") to construct, own and maintain a right-of-way encroachment ("Encroachment") at 1806 Emerson Street, Philadelphia, PA 19152 as follows:
Encroachment Description
An existing retaining wall, running along the property frontage of 1806 Emerson Street. Said retaining wall encroaches five and one half feet (5'-5") into the southerly footway of Emerson Street, with eight feet six inches (8'-6") footway space remaining. The retaining wall, being three feet seven inches (3'-7") high, with four (4) decorative columns extending to four feet ten inches (4'-10") high above the Emerson Street sidewalk, extends approximately three feet (3'-0") below grade, as shown on plan titles "Site Plan Wall Detail" as prepared by Richard Brown, RA, and dated May 7, 2014. Within this retaining wall were also constructed five (5) lateral retaining walls and steps (3'-9" wide), extending from the parcel to the retaining wall, and situated at each of one (1) property boundary, two (2) sides of the existing steps, one (1) side of an existing driveway, and one (1) side of an existing driveway and property boundary.
SECTION 2. The construction, use and maintenance of the Encroachment described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections, the Department of Streets, and the Art Commission, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering practice.
