Authorizing Alvin Shipon, ("Owner") to install, own and maintain an open-air sidewalk café at 342-344 Queen Street, Philadelphia, PA 19147 ("Property"), under certain terms and conditions.

Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Owner to install, own and maintain an open-air sidewalk café at the Property ("Encroachments"). A total of seven (7) tables to accommodate a total of twenty-four (24) occupants, are proposed as follows:

Encroachment Description:

Two (2) tables and four (4) chairs will be located adjacent to the building approximately twenty-six feet-zero inches (26'-0'') from the east curb line of 4th Street and will encroach approximately two feet - zero inches (2' - 0") onto the south footway of Queen Street leaving a minimum eight feet - zero inches (8' - 0") of clear unobstructed footway. No rails will be used.

Five (5) tables and twenty (20) chairs will be located adjacent to the building approximately eighteen feet-zero inches (18'-0'') from the south curb line of Queen Street and will encroach approximately four feet - six inches (4' - 6") onto the east footway of 4th Street leaving a minimum five feet - six inches (5' - 6") of clear unobstructed footway. No rails will be used.


SECTION 2. The installation, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections and the Department of Streets, provided that the Department of Streets, in its sole discretion, may allow minor variations of the dimension limits set forth in Section 1, within standard tolerances of current engineering practice.
