Title
Amending Title 12 of The Philadelphia Code, entitled "Traffic Code," by adding a new Chapter 12-3200, entitled "Fee for Local Use," to impose a fee on each nonexempt vehicle registered to an address located in the City, all under certain terms and conditions.

Body

WHEREAS, under Act 89 of 2013, the Pennsylvania General Assembly authorized municipalities to raise new revenues in connection with vehicle registrations for maintenance, repair, and enhancement of safety in the right of way; and

WHEREAS, City Council finds that further funding for these purposes is essential to improving the condition of our streets for vehicles, pedestrians, cyclists, and all other users; and

WHEREAS, City Council further finds that accidents and fatalities in the right of way can be further reduced or prevented altogether by application of sound analysis of data and smart policies; and

WHEREAS, funding such as that authorized by Act 89 will contribute to realizing the vision of better and safer rights of way; NOW, THEREFORE,


THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Title 12 of The Philadelphia Code is hereby amended to read as follows:

TITLE 12. TRAFFIC CODE.

CHAPTER 12-3200. FEE FOR LOCAL USE.

§12-3201. Fee Imposed for Local Use. Pursuant to 75 Pa. C.S. §1935, a fee of five dollars ($5) shall be imposed on each nonexempt vehicle registered to an address in the City to be collected by the Commonwealth's Department of Transportation. The fee shall be imposed at the time a vehicle is registered or at the time a vehicle's registration is renewed.

§ 12-3202. Use of the Fee revenue. Pursuant to Pa. Const. Art. 8, § 11, funds received on account of the fee imposed pursuant to this Chapter shall be used solely for construction, reconstruction, maintenance and repair of and safety on public highways and bridges and costs and expenses incident thereto, and for the payment of obligations incurred for such p...
