Title
Authorizing the Commissioner of Public Property and the Director of Commerce, acting on behalf of the City to enter into an agreement with Tinicum Township, Delaware County, for the lease and purchase from Tinicum Township of an approximately 21.8 acre parcel of land adjacent to Philadelphia International Airport which is currently in use as a safety area at the end of a runway, under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. The City of Philadelphia (the “City”) is hereby authorized to lease and purchase from Tinicum Township, Delaware County, an approximately 21.8 acre parcel of land (the “Premises”) owned by and within Tinicum Township and adjacent to Philadelphia International Airport (the “Airport”), which is currently in use as a safety zone at the end of an Airport runway, the Premises being more fully set forth on Exhibit “A” attached hereto, the metes and bounds set forth on such exhibit being approximations and not necessarily exact. The Premises is currently being leased by the City from Tinicum Township pursuant to Bill No. 050337 enacted in 2005. The transaction is part of a Settlement Agreement between the City, Tinicum Township, Interboro School District and Delaware County executed in April, 2015.
SECTION 2. The Commissioner of Public Property and the Director of Commerce, or their designee(s), acting on behalf of the City, and hereby authorized to execute and deliver an agreement with Tinicum Township for such purpose with a fifty (50) year term and to take any and all further actions as may be necessary or appropriate to accomplish the intent and purpose of this Ordinance.
SECTION 3. The Lease/Purchase Agreement shall be substantially in the form set forth in Exhibit “B” attached hereto and made a part hereof, with such changes as the City Solicitor deems necessary or appropriate to protect the interests of the City.
SECTION 4. The Commissioner of Public Property and the Director of Commerce, or their designee (s), acting on behalf of the City, are hereby authorized to execute and deliver any and all other documents, agreements or instruments (a) related to the Lease/Purchase and the satisfaction of the City’s obligation thereunder and (b) necessary or appropriate to effectuate the Lease/Purchase or this Ordinance, all of which shall contain such terms and conditions as the City Solicitor shall deem necessary or appropriate to protect the interests of the City.
SECTION 5. The Chief Clerk of City Council shall keep on file all exhibits referenced in this Ordinance and shall make them available for inspection by the public during regular office hours.
