Authorizing Rachel Miller of Best Partners LP, ("Owner") to install, own and maintain an open-air sidewalk café at 4301 Baltimore Avenue, Philadelphia, PA 19104 ("Property"), under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Owner to install, own and maintain a sidewalk café at the Property ("Encroachment") as follows:

Encroachment Description:

A sidewalk café, along the building line of 4301 Baltimore Avenue from a point approximately two feet (2'-0") east of the southeast corner building line of 4301 Baltimore Avenue, extending approximately twenty five feet (25'-0") further west, and extending approximately eleven feet (11'-0") into the northerly footway of Baltimore Avenue, with eleven feet four inches (11'-4") clear walkable space remaining, with two (2) nine foot four inch (9'-4") pinch points. Movable planters/barricades are to be proposed as shown on the approved plans.


SECTION 2. The installation, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses & Inspections and the Department of Streets, provided that the Department of Streets, in its sole discretion, may allow minor variations of the dimension limits set forth in Section 1, within standard tolerances of current engineering practice.

SECTION 3. Before exercising any rights or privileges under this Ordinance, Owner must first obtain all required permits, licenses and approvals from all appropriate City departments, boards, agencies or commissions. No such department, board, agency or commission shall be required to issue any such permit, license or approval solely because this Ordinance has been enacted, it being the express intent of this Ordinance not to supersede any other provision of law governing the issuance of...
