Title: Amending Title 17 of The Philadelphia Code, entitled "Contracts and Procurement," by adding a new category of Disadvantaged Business Enterprises and of City contracts entitled "Lesbian, Gay, Bisexual, and Transgender Persons," that must be considered separately by the Finance Director in conducting the Annual Disparity Study and devising the Annual Participation Goals as required by Section 6-109 of The Philadelphia Home Rule Charter; and also adding a rebuttable presumption that Lesbian, Gay, Bisexual, and Transgender Persons are Socially and Economically Disadvantaged Individuals; and further adding a definition of "Lesbian, Gay, Bisexual, and Transgender Persons;" and finally recognizing religious prejudice as a form of prejudice because of identity as a member of a group whose ability to compete in the free enterprise system has been impaired due to diminished capital and credit opportunities as compared to others in the same business who have not been subject to such prejudice or ...

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Title 17 of The Philadelphia Code is hereby amended to read as
follows:

ยง17-1501. Definitions.

(1) African American. A person having origins in any of the black racial groups in Africa.

(2) Asian American. A person having origins in any of the original peoples of the Far East, Southeast Asia, the Indian Subcontinent or the Pacific Islands.

(3) Disabled person. An individual who has a physical or mental impairment which substantially limits one or more of his or her major life activities or has a record of such impairment. "Major life activities" means functions such as caring for oneself, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning and workin...
