Title

Amending Section 12-2405.1 of The Philadelphia Code, entitled “Removal of Vehicles Blocking Driveways,” by authorizing the Department of Streets or other department designated by the Mayor to create and maintain an inventory and database of certain driveways and parking spaces and to publish such information on the City’s official website, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1. Chapter 12-2400 of The Philadelphia Code is hereby amended to read as follows:

 

CHAPTER 12-2400.  TOWING AND IMMOBILIZING OF PARKED

OR ABANDONED VEHICLES

§ 12-2405.1.  Removal of Vehicles Blocking Driveways.

 

(1)   The owner or other person in charge or possession of any driveway, or in charge or possession of any private parking space, access to which is only available by means of a driveway, may remove or have removed any vehicle from the street or the driveway which is parked or left unattended in a manner so as to block access to such driveway. Removal shall be at the expense of the owner of the vehicle.

 

(2)   The Department of Streets or other department designated by the Mayor is  authorized to: (i) create and maintain an inventory and database of all driveways and private parking spaces, from which an owner or possessor is authorized to remove any unattended vehicle blocking access thereto; and (ii) make the database available to the public by publishing it in an electronic and searchable format on the City’s official website. 

 

SECTION 2.  This Ordinance shall become effective immediately.
