Authorizing the Commissioner of Public Property, on behalf of the City, to acquire a bridge that crosses the Schuylkill River below the Grays Ferry Bridge and to acquire rights or property interests in connection with supports for the bridge and its abutments, all under certain terms and conditions.

 

Body

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

                     SECTION 1. The Commissioner of Public Property, on behalf of the City, is hereby authorized to acquire a swing bridge that crosses the Schuylkill River below the Grays Ferry Bridge, known as the Abandoned Philadelphia, Wilmington, Baltimore Railroad Bridge No. 1) (the “Swing Bridge”) and located in the area identified as the “Swing Bridge Location” in Exhibit “A” to this Ordinance; and to acquire any of the Swing Bridge’s abutments or piers, the parcels of land on which the abutments or piers are located, or other facilities associated with the Swing Bridge  (“Swing Bridge Abutment Properties”), which are generally located in the area identified as the “Swing Bridge Abutment Properties” in Exhibit “A” to this Ordinance; and to acquire any lesser interest in any of such properties.

 

                     SECTION 2.  The Commissioner of Public Property is hereby authorized to execute any documents necessary or appropriate for the purpose of accepting title, or a lesser property interest, in the Swing Bridge or any of the Swing Bridge Abutment Properties.

 

                     SECTION 3. The City Solicitor is hereby authorized to include those provisions in any deeds or agreements associated with such acquisitions as the City Solicitor deems necessary or prudent to protect the interests of the City.

 

                     SECTION 4. Upon vesting of title in the City to the Swing Bridge or any of the Swing Bridge Abutment Properties, such properties shall be deemed incorporated into the Schuylkill River Park, and shall likewise be a part of the Fairmount Park System, consistent with Section 15-201 of The Philadelphia Code.
