Authorizing Mulherin Partners LLC, ("Owner") to install, own and maintain an open-air sidewalk café at 1355 Front Street, Philadelphia, PA 19122 ("Property"), under certain terms and conditions.

Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Owner to install, own and maintain an open-air sidewalk cafe at the Property ("Encroachments") as follows:

Encroachment Description:

A sidewalk café, at the referenced location in two (2) sections.

Section One, ten (10) tables and forty chairs (40) located along the building line on Master Street from a point approximately ten feet (10'-0") west of the west curb line of Lee Street to a point approximately twelve feet nine inches (12'-9") east of the east curb line of Front Street, encroaching three feet six inches (3'-6") onto the South footway of Master Street leaving a minimum of five feet (5'-0") of clear unobstructed footway. No rails will be used.

Section Two, eleven (11) tables and twenty-two chairs (22) located adjacent to the South curb line of Master Street from a point approximately ten feet (10'-0") west of the west curb line of Lee Street to a point approximately twelve feet nine inches (12'-9") east of the east curb line of Front Street, encroaching three feet six inches (3'-6") onto the South footway of Master Street leaving a minimum of five feet (5'-0") of clear unobstructed footway. No rails will be used.

SECTION 2. The installation, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses & Inspections and the Department of Streets, provided that the Department of Streets, in its sole discretion, may allow minor variations of the dimension limits set forth in Section 1, within standard tolerances of current engineering practice.
