Authorizing Philadelphia License Number One, Inc., ("Owner") to install, own and maintain an open-air sidewalk café at 1200 S. 21st Street, Philadelphia, PA 19146 ("Property"), under certain terms and conditions.

Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Owner to install, own and maintain an open-air sidewalk café at the Property ("Encroachments") as follows, and as further detailed in the Plan approved _______ by the Streets Department, and attached hereto as "Exhibit A":

Encroachment Description:

Five (5) tables and sixteen (16) chairs will be located adjacent to the building from approximately fourteen feet - six inches (14'-6") West of the West curb line of South 21st Street, extending to a point approximately thirty-eight feet - six inches (38'-6") farther West and will encroach approximately four feet - 0 inches (4'-0") onto the South footway of Federal Street leaving a minimum seven feet - four inches (7'-4") of clear unobstructed footway. No rails will be used.

SECTION 2. The installation, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses & Inspections and the Department of Streets, provided that the Department of Streets, in its sole discretion, may allow minor variations of the dimension limits set forth in Section 1, within standard tolerances of current engineering practice.

SECTION 3. Before exercising any rights or privileges under this Ordinance, Owner must first obtain all required permits, licenses and approvals from all appropriate City departments, boards, agencies or commissions.
