Authorizing Fishtown Arts & Crafts LLC dba Fishtown Social, ("Owner") to install, own and maintain an open-air sidewalk café at 1523-27 Frankford Avenue, Philadelphia, PA 19125 ("Property"), under certain terms and conditions.

Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Owner to install, own and maintain an open-air sidewalk cafe at the Property ("Encroachments") as follows:

Encroachment Description:

A sidewalk café, at the referenced location consisting of four (4) tables and sixteen chairs (16) located along the building line on Frankford Avenue from a point approximately seven feet (7'-0") North of the south property line of the referenced location to a point approximately twenty four feet (24'-0") farther north, encroaching approximately five feet (5'-0") onto the east footway of Frankford Avenue leaving a minimum of five feet (5'-0") of clear unobstructed footway. No rails will be used.

SECTION 2. The installation, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses & Inspections and the Department of Streets, provided that the Department of Streets, in its sole discretion, may allow minor variations of the dimension limits set forth in Section 1, within standard tolerances of current engineering practice.

SECTION 3. Before exercising any rights or privileges under this Ordinance, Owner must first obtain all required permits, licenses and approvals from all appropriate City departments, boards, agencies or commissions. No such department, board, agency or commission shall be required to issue any such permit, license or approval solely because this Ordinance has been enacted, it being the express intent of this Ordinance not to supersede any other provision of law governing the issuance of such permits, li...
