THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Franko Borda, ("Owner") to construct, own and maintain a right-of-way encroachment ("Encroachment") at 1549 S. 13th Street, Philadelphia, PA 19147 as follows:

Encroachment Description:

An elevated patio with 36" rails and at 1549 South 13th Street in two parts:

Part 1

From a point on along the along the 13th Street building line of the referenced location, fifteen feet three inches (15'-3") north of the north curb line of Tasker Street, extending twenty nine feet nine inches (29'-9") further north, and encroaching five feet four inches (5'-4") into the easterly footway of South 13th Street, maintaining 6'-0" of clear walkable space with two (2) five foot (5'-0") pinch points.

Part 2

From a point on along the along the Tasker Street building line of the referenced location, nineteen feet nine inches (19'-9") east of the east curb line of South 13th Street, extending twenty three feet three inches (23'-3") further east, and encroaching five feet two inches (5'-2") into the northerly footway of Tasker Street, maintaining 6'-2" of clear walkable space with one (1) five foot (5'-0") pinch point.


SECTION 2. The construction, use and maintenance of the Encroachment described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections, the Department of Streets, and the Art Commission, provided that the Department of Streets, in its sole, unreviewable discretion, may allow minor variations of the dimension limits of Section 1, within standard tolerances of current engineering practice.
