Authorizing Property Owner ("Owner") to install, own and maintain an open-air sidewalk café in two parts, at 3847 Terrace Street, Philadelphia, PA 19128 ("Property"), under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Owner to install, own and maintain an open-air sidewalk café at the Property in two parts ("Encroachments") as follows:

Encroachment Description:

Part 1

A maximum of two tables and four chairs will be located along the building line on Terrace Street from a point fifteen feet six inches (15'-6") south of the south curbline of Salaignac Street to a point fifteen feet (15'-0") farther south and encroaching five feet (5'-0") onto the east footway of Terrace Street leaving a minimum of five feet (5'-0") of clear unobstructed footway. No rails will be used.

Part 2

A maximum of two tables and four chairs will be located along the building line on Salaignac Street from a point fifteen feet six inches (15'-6") east of the east curbline of Terrace Street to a point twenty-one feet (21'-0") farther east and encroaching four feet (4'-0") onto the south footway of Salaignac Street leaving a minimum of five feet (5'-0") of clear unobstructed footway. No rails will be used.

SECTION 2. The installation, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses & Inspections and the Department of Streets, provided that the Department of Streets, in its sole discretion, may allow minor variations of the dimension limits set forth in Section 1, within standard tolerances of current engineering practice.

SECTION 3. Before exercising any rights or privileges under this Ordinance, Owner must first obtain all required permits, licenses and approvals from all appropriate City departments,...
