Title

Amending Chapter 9 of Subcode “A” (The Philadelphia Administrative Code) of Title 4 of The Philadelphia Code (The Philadelphia Building Construction and Occupancy Code), entitled “Fees,” and Chapter 14-1000 of The Philadelphia Code, entitled “Historic Preservation,” to provide for fees for review by the Historical Commission of certain permit and other applications and requests for approvals; and requiring reporting on fees collected; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1.  Chapter 9 of Subcode A of Title 4 of The Philadelphia Code is amended to read as follows:

SECTION A-902  BUILDING, FUEL GAS AND MECHANICAL CODE FEES

 

A-902.1 General: Fees for permits, appeals, certificates and administrative services related to activity regulated by the Building, Fuel Gas and Mechanical Codes, and for reviews pursuant to Chapter 14-1000 (“Historic Preservation”), shall be as set forth in this Section.

 

A-902.2 Construction:  Permit fees for new construction, additions, alterations, demolition, occupancy and repairs shall be as set forth in Sections A-902.2.1, except as otherwise specified in Sections A-902.2.2 through A-902.2.10.  Fees for Historical Commission review in connection with permitting for new construction, additions, alterations and demolition shall be as set forth in Section A-902.2.11.

A-902.2.11                      Historical Commission Review.   The fee for Historical Commission review in connection with permitting for new construction, additions, alterations and demolition shall be 25% of the amount of the associated building or demolition permit, provided that the minimum fee shall be $50.00 and the maximum fee shall be $10,000.00, and further provided that such amount shall be rounded to the next lower $5.00 increment.

 

Exceptions:                     

 

                      1.                     Where construction or demolition work is limited to the interior portion of a building, and no public interior portion of the building has been designated as historic under this Chapter, the fee shall be 50.00, provided that if the cost of the construction or demolition work is $10,000.00 or less there shall be no fee.

 

                     2.                     The fee shall be waived when an exemption is granted pursuant to subsection 14-1005(6)(e)(.7) based in part on the financial circumstances of the applicant.

 

                     3.                     Applications seeking a determination that the building, structure, site, or object cannot be used for any purpose for which it is or may be reasonably adapted under subsection 14-1005(6)(d) in connection with an application for a demolition permit shall be subject to a surcharge fee of $10,000.00, in addition to the review fee under the this Section.

SECTION 2.   Chapter 14-1000 of The Philadelphia Code is amended to read as follows:

 

CHAPTER 14-1000.  HISTORIC PRESERVATION.

§ 14-1009.  Fees.

 

                      (1)                       Historical Commission reviews of permits for new construction, additions, alterations and demolition construction shall be subject to the fees set forth in Chapter 9 of Subcode “A” (The Philadelphia Administrative Code) of Title 4 (The Philadelphia Building Construction and Occupancy Code). 

 

                     (2)                     No approval shall be considered final until the designated fee has been paid.

 

                     (3)                     The Director of Finance or his designee shall by September 1 of each year submit to the Mayor, with a copy to the President and Chief Clerk of Council, a written report summarizing the fees collected for Historical Commission review in connection with permitting for each of the following categories in the previous fiscal year, along with the total number of fee payers in each category:  new construction; additions and alterations; and demolition.
