Amending Chapter 11-600 of The Philadelphia Code, entitled "Construction, Encroachments and Projections Over, On and Under Streets," to provide additional requirements in connection with sidewalk closures, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Chapter 11-600 of The Philadelphia Code is amended to read as follows:
TITLE 11. STREETS.

CHAPTER 11-600. CONSTRUCTION, ENCROACHMENTS AND PROJECTIONS OVER, ON AND UNDER STREETS.

§ 11-601. Definitions.

(8.1) Protected Walkway. A portion of a sidewalk, roadway or street open to pedestrian traffic that is bordered by barriers adequate to protect the safety of pedestrians.

§ 11-612. Sidewalk and Roadway Lane Closures.

(2) The Department shall not issue any permit authorizing the closure of any sidewalk, or portion of a sidewalk, under the provisions of this Title 11, any regulation promulgated under this Title, or any other authority, without first making a written determination that a covered walkway in compliance with Title 4 is impracticable in the circumstances, and, if so, whether a protected walkway can be established that will adequately protect public safety and not unduly impact traffic safety. If a permit application seeks closure of a sidewalk that will extend beyond one week, then the permit application must be accompanied by an analysis prepared by an engineer licensed by the Commonwealth of Pennsylvania concluding [that] whether a covered walkway in compliance with Title 4 is [impracticable] practicable in the circumstances, and, if not, whether a protected walkway can be established that will adequately protect public safety and not unduly impact traffic safety.
