Title

Authorizing acceptance of the dedication to the City of the bed of Westmoreland Street from a point approximately one_hundred ninety_seven feet west of Third Street to a point approximately sixty_six feet further westwardly therefrom and authorizing acceptance of the grant to the City of certain areas adjacent to the said Westmoreland Street as slope easements, under certain terms and conditions.

 

Body

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1.  The Board of Surveyors of the Department of Streets is hereby authorized to accept a deed of dedication from The School District of Philadelphia granting to the City for use as a public street or highway the bed of Westmoreland Street from a point approximately one_hundred ninety_seven feet west of Third Street to a point approximately sixty_six feet further westwardly therefrom, provided, that the said dedication is made without cost to the City and free and clear of all encumbrances.

 

SECTION 2.  The Streets Commissioner, on behalf of the City of Philadelphia, is hereby authorized to accept the grant to the City by The School District of Philadelphia of certain areas adjacent to the lines of said Westmoreland Street as slope easements for the purpose of supporting and protecting the area within the bed of said Westmoreland Street, including the placement and maintenance of drainage facilities to protect the highway, provided, that said grant shall be made without cost to the City.  Acquisition by the City of property as a slope easement shall not prevent the property owner from making any use of the area covered by the slope easement so long as that use is not detrimental to the support of the highway or the safety of the traveling public.

 

SECTION 3.  All necessary land areas and other real estate interests to be acquired under authority of Sections 1 and 2 herein are described and delineated in Exhibit “A” attached hereto.  Exhibit “A” to this Ordinance shall be kept on file by the Chief Clerk and shall be available for public inspection.

 

SECTION 4.  The City Solicitor is hereby authorized to review and approve all instruments and documents necessary to effectuate this Ordinance, which instruments and documents shall contain such terms and conditions as the City Solicitor shall deem necessary or appropriate to protect the interests of the City.
