Amending Chapter 9-500 of The Philadelphia Code (entitled “Boilers, Fuel, Heat and Refrigeration”) to revise certain provisions relating to licenses and fees and delete provisions relating to warm air heating apparatus; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

 

SECTION 1.                     Chapter 9-500 of The Philadelphia Code is amended to read as follows

 

CHAPTER 9-500.  BOILERS, FUEL, HEAT AND REFRIGERATION.

 

§ 9-501.  Boilers, Engines, and Refrigeration Machinery.

                     (2)                     Licenses.

 

(a)                     Licenses shall be divided into the following [five] four grades:

 

                     (.1)                     Grade A – steam boiler, stationary and refrigeration engineer;

 

                     (.2)                     [Grade A-1 – steam boiler, stationary or refrigeration engineer employed exclusively by and for the School District of Philadelphia;

 

                     (.3)]                     Grade B – refrigeration engineer;

 

                     [(.4)] (.3)                     Grade C – portable and stationary engineer;

 

                     [(.5)] (.4)                     Grade D – fireman.

 

(b)                     No license shall be issued unless the applicant:

 

                                                               (.1)                     is 18 years of age;

 

                                                               (.2)                     [for Grades A, B, C and D] has had at least two (2) years of experience as an assistant engineer or helper, and is recommended by two licensed engineers; [. Experience as a Grade A-1 engineer employed by the School District of Philadelphia does fulfill the requirements of this Section;]

 

                                                               [(.3)                     if an applicant for the Grade A-1 license, has been recommended by the School District of Philadelphia Administrator of Management Services;]

 

                                                               [(.4)]                     (.3)   has passed [the] an examination [or investigation] prescribed by [regulation of] the Department, to determine professional qualifications [and good moral character];

 

                                                               [(.5)] (.4)  in connection with an initial license, pays [an examination] a non-refundable application fee of [twenty-five (25) dollars for Grades A, B, C and D and thereafter] $20, which shall be credited toward the annual fee if the license is issued; and

 

                                                                (.5)                      pays an annual license fee of [twenty (20) dollars for Grades A, A-1, B, C and D] $50.

 

                                          (c)                     All licenses shall be conditioned upon continued compliance by the licensee with the applicable provisions of this Chapter and Title [5] 4 of this Code (The Philadelphia Building and Construction Occupancy Code).

 

                                          [(d)                     Grade A-1 license shall be limited to employees of the School District of Philadelphia and shall expire immediately upon termination of employment from the School District.]

 

                                          [(e)                     Sunset Provision. Three years from the date the ordinance adding this sunset provision became law, all provisions of this Section relating to the Grade A-1 license shall be repealed, except for the provision of subsection 9-501(2)(b)(.2) relating to experience as a Grade A-1 engineer fulfilling the experience requirements for the Grade A, B, C and D licenses. On and after such date, no new Grade A-1 licenses shall be issued, and possession of a Grade A-1 license shall not satisfy the license requirement of this Section.]

§ 9-504.  [Warm Air Heating Apparatus.]  Reserved.

 

[(1)                     Licenses.

 

                      (a)                     No person shall engage in the business of installing or repairing warm air heating apparatus connected with flues or chimneys in any dwelling or building unless he has obtained a license from the Department of Licenses and Inspections.

 

                                          (b)                     No license shall be issued unless the applicant:

                                                               

(.1)                     is 21 years of age;

 

                                                               (.2)                     has satisfactorily passed the examination or investigation prescribed by the Department to determine professional qualifications and good moral character;

 

                                                               (.3)                     pays an original license fee of $50.00 and thereafter an annual renewal license fee of $40.00.

 

                                          (c)                     All licenses shall be conditioned upon continued compliance with the provisions of this Section. 

 

(2)                     Permits. No person shall install any warm air heating apparatus in any dwelling or building unless he has obtained a permit pursuant to § 3-301.

 

                     (3)                     Manner of Installation or Repair. No person shall install or repair any warm air heating apparatus so that:

 

                                          (a)                     it is connected with any flue or outlet which is not properly protected or found to be unsafe;

 

                                          (b)                     it is not in compliance with the requirements of Titles 3 and 5.

 

                     (4)                     Certification. Upon completion of any installation or repair, the licensee shall so certify to the Fire Department.]
