Title
Authorizing Owen Kamihira, ("Owner") of Bar Fred LLC, to install, own and maintain an open-air sidewalk café at 1040 North 2nd Street, Philadelphia, PA 19123 ("Property"), under certain terms and conditions.

Body
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Owner to install, own and maintain an open-air sidewalk cafe at the Property ("Encroachments") as follows:

Encroachment Description:
A sidewalk café, at the referenced location consisting of eight (8) tables and sixteen (16) benches (seating for 30) located along the east building line on N 2nd Street from a point approximately ten feet two inches (10'-2") South of the northern property line extending approximately eighty one feet (81') farther south, encroaching approximately five feet (5'-0") onto the west footway of N 2nd Street leaving a minimum of six feet seven inches (6'-7") of clear unobstructed footway. No rails will be used.

SECTION 2. The installation, use and maintenance of the Encroachments described and listed in Section 1 shall be in accordance with the laws, rules and regulations of the City of Philadelphia, and specifically those of the Department of Licenses and Inspections and the Department of Streets, provided that the Department of Streets, in its sole discretion, may allow minor variations of the dimension limits set forth in Section 1, within standard tolerances of current engineering practice.

SECTION 3. Before exercising any rights or privileges under this Ordinance, Owner must first obtain all required permits, licenses and approvals from all appropriate City departments, boards, agencies or commissions. No such department, board, agency or commission shall be required to issue any such permit, license or approval solely because this Ordinance has been enacted, it being the express intent of this Ordinance not to supersede any other provision of law governing the issuance of such permits, licenses or ...
